When someone dies leaving a Will you must apply for a grant of probate. This confirms that the person is dead, the Will is authentic and confirms that an Executor is authorised to manage the assets of the deceased

Sometimes, unfortunately, people do not make a Will even when they should. A person who dies without making a Will dies intestate and there are statutory rules governing intestacy.

The nearest next-of-kin is entitled to take out a Grant of Administration to the Estate, which entitles them to manage the assets of the deceased and administer the Estate.

Very few Estates can really be described as simple to administer. Any Executor or Administrator takes on full PERSONAL legal and financial responsibility for the entire Estate Administration.

This means that if something goes wrong you will have to personally pay for any errors, incorrect accounting or distributions to the incorrect persons, now and in the future.
